Award N°1131 – Damages to the cargo – Contradictory tally reports – Carrier’s responsability. When, following cargo pilferage as well as numerous damages at the discharging port, a Captain signed the out-turn reports without any accurate and justified reservations but with simple comments, merely on principle, arbitrators decided that out-turn reports are deemed to have been signed contradictorily and owner’s responsibility is bound in accordance with the Brussels Convention applicable as a result of the Paramount clause incorporated into the bill of lading.
