Award N°1160 – Gencon c-p – Voyage not performed – Chartering of a substitute vessel. The time-charterer of a vessel, chartering her out for a voyage, is responsible for the non performance when the headowner refuses to perform the voyage because vessel’s certificates do not allow her to trade towards the contemplated area. The time-charterer is ordered to pay additional costs for the chartering of a substitute vessel.
