Award N°1161 – Gencon c-p – Cargo to be loaded « always last in/first out » – Deviation – Late delivery of cargo – Penalty. « Always last in/first out » means that the voyage under a Gencon c-p must be performed through the safer direct route from the last port of loading to the first port of discharge. The owner has no rights to reroute the vessel for commercial purposes and is liable for the resulting prejudice, based on late arrival penalties flowing from a closely related contract which was taken as evidence.
